These Terms of Service ("Terms") govern your use of beatbagz.com (the "Site") and your purchase of products from GHS Products LLC, a Texas limited liability company doing business as Beat Bagz ("Beat Bagz," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy, Shipping Policy, and Subscription Policy, which are part of these Terms. If you don't agree, please don't use the Site.

1. You must be 18 or older

The Site sells adult products. By using the Site or placing an order, you confirm that you are at least 18 years old (or the age of majority where you live, if higher) and that it is legal for you to view, purchase, and receive the products where you are. We may cancel any order if we have reason to believe these conditions aren't met.

2. The products

Beat Bagz are single-use male sleeves made of thermoplastic elastomer (TPE) gel, sold in packs, intended for personal, intimate use by adults.

Use them as intended. Please read and follow any instructions included with the product. In particular:

  • Single use only. Use once, then dispose of it. Do not wash and reuse.
  • Water-based lubricant recommended. Oil-based lubricants can degrade TPE.
  • Stop if something's wrong. If you experience irritation, discomfort, or an allergic reaction, stop using the product and consult a healthcare provider. Do not use on broken or irritated skin.
  • Not a contraceptive, and not protection. Beat Bagz are not condoms or medical devices. They do not prevent pregnancy or protect against sexually transmitted infections.
  • Keep away from children and pets.
  • Dispose of it in the trash. Don't flush it.

Not medical advice. Nothing on the Site is medical advice or a substitute for a conversation with a healthcare provider. We make no health, therapeutic, or medical claims about our products.

Product images are 3D renders. We think they're accurate, but the real thing may differ slightly in color, clarity, and appearance. Product descriptions, specifications, and pricing may occasionally contain errors; we reserve the right to correct them, and to cancel or refuse any order placed at an incorrect price, with a full refund.

3. Orders, pricing, and payment

  • Your order is an offer. We accept it when we ship. We may refuse or cancel any order — for example, for suspected fraud, resale, order-quantity limits, unavailable stock, pricing errors, or age concerns — and if we do, we'll refund anything you've paid.
  • Prices are in U.S. dollars and may change at any time without notice. Price changes don't affect orders already placed.
  • Sales tax is collected where we're required to, and shown at checkout.
  • Payment. You authorize us and our payment processor to charge your chosen payment method for your order, including shipping and tax. You represent that you're authorized to use that payment method.
  • Discount codes have no cash value, can't be combined unless we say so, and may be withdrawn or modified at any time.
  • Charges appear on your statement as "GHS PRODUCTS LLC." Please check for that before disputing a charge you don't recognize — and email us first. See our Refund Policy.

4. Shipping and risk of loss

Shipping terms, delivery estimates, and what happens if a package is lost or damaged are in our Shipping Policy. Title to and risk of loss for products pass to you upon delivery to the shipping address you provide.

5. Refunds and cancellations

We don't accept returns of any kind. Instead, we offer a 30-Day Money-Back Guarantee on your first order and cover damaged, defective, and incorrect items in full. The complete terms are in our Refund Policy.

6. Subscriptions

If you purchase a subscription, you authorize us to charge your payment method on a recurring basis at the price and frequency you select at checkout, until you cancel. You can skip, pause, change, or cancel anytime from your account or by emailing us, with no fees or minimum term. 7. Your account

You may create an account to manage orders and subscriptions. You're responsible for keeping your login credentials confidential and for all activity under your account. Give us accurate information and keep it current. Let us know at hey@beatbagz.com if you think your account has been compromised.

8. Emails and texts

If you sign up for our emails or texts, you agree to receive marketing messages from Beat Bagz at the address or number you provide. You can unsubscribe anytime using the link in any email or by replying STOP to any text. Message frequency varies; message and data rates may apply. We'll still send you transactional messages about your orders and account.

9. Reviews and other content you submit

If you submit a review, photo, comment, or other content to the Site or to us, you grant Beat Bagz a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, edit, publish, and display that content in connection with our business, including in marketing, with or without your name or handle. You represent that you own the content, that it's accurate and based on your own experience, and that it doesn't violate anyone's rights or any law.

We may remove or decline to publish any content for any reason. Don't submit content that is illegal, defamatory, obscene, infringing, harassing, or that identifies anyone other than yourself without their consent.

10. Acceptable use

You agree not to:

  • use the Site if you're under 18 or misrepresent your age;
  • purchase products for resale without our written permission;
  • use bots, scrapers, or other automated tools to access the Site or its data;
  • interfere with the Site's security or operation, or attempt to access accounts or systems that aren't yours;
  • use the Site for any unlawful purpose or in violation of these Terms.

We may suspend or terminate your access to the Site for violating these Terms.

11. Intellectual property

The Site and everything on it — the Beat Bagz name and logo, product designs, renders, images, text, graphics, and code — belong to GHS Products LLC or our licensors and are protected by trademark, copyright, and other intellectual property laws. BEAT BAGZ is a trademark of GHS Products LLC. You may use the Site for personal, non-commercial purposes only. Don't copy, reproduce, distribute, or create derivative works from any part of it without our written permission.

If you believe content on the Site infringes your copyright, email hey@beatbagz.com with the details and we'll look into it promptly.

12. Third-party links and affiliates

The Site may link to third-party websites, and third-party websites may link to us. We aren't responsible for their content, policies, or practices. Some sites that link to us are affiliates who may earn a commission on purchases they refer; that doesn't change the price you pay.

13. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, AND WE DON'T GUARANTEE THAT IT WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

EXCEPT FOR THE MONEY-BACK GUARANTEE AND THE DAMAGED / DEFECTIVE / INCORRECT ITEM COVERAGE DESCRIBED IN OUR REFUND POLICY, WE MAKE NO WARRANTIES ABOUT THE PRODUCTS, EXPRESS OR IMPLIED, AND TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions don't allow the exclusion of implied warranties, so some of the above may not apply to you.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GHS PRODUCTS LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, THE PRODUCTS, OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE, THE PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that can't be limited under applicable law. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless GHS Products LLC and its owners, employees, contractors, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site or the products, or content you submit.

16. Governing law

These Terms and any dispute between you and Beat Bagz are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules.

17. Dispute resolution — please read this section carefully

Talk to us first. Most problems are solved with an email. Before starting any formal proceeding, you agree to email us at hey@beatbagz.com with a description of the issue and what you'd like us to do about it, and to give us 60 days to work it out with you. We'll do the same before bringing a claim against you.

Binding individual arbitration. If we can't resolve a dispute informally, you and Beat Bagz agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the products will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not in court. The Federal Arbitration Act governs this agreement to arbitrate. The arbitrator's decision is final and binding, and judgment on the award may be entered in any court with jurisdiction. Arbitration will take place in Hays County, Texas, or by video or phone if you prefer; if you attend in person, we'll follow the AAA rules on how the costs are split.

Small claims exception. Either of us may bring an individual claim in small claims court instead of arbitration, as long as it stays in small claims court.

Class action waiver. YOU AND BEAT BAGZ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding. If this waiver is found unenforceable for a particular claim, then that claim (and only that claim) must be brought in court, in Hays County, Texas, and the rest of this section still applies.

Your right to opt out. You can opt out of this arbitration agreement by emailing hey@beatbagz.com within 30 days of your first purchase, with your name, order number, and a clear statement that you want to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Hays County, Texas, and you and we consent to the personal jurisdiction of those courts.

18. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top tells you when. Changes take effect when posted, except that changes to the Dispute Resolution section don't apply to disputes that arose before the change. Continuing to use the Site or place orders after a change means you accept the updated Terms.

19. General

  • Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
  • No waiver. If we don't enforce a provision, that's not a waiver of our right to enforce it later.
  • Assignment. You may not transfer your rights under these Terms. We may assign them in connection with a sale, merger, or reorganization of our business.
  • Force majeure. We're not responsible for delays or failures caused by events beyond our reasonable control, such as carrier disruptions, natural disasters, or supplier failures.
  • Entire agreement. These Terms, together with the policies referenced in them, are the entire agreement between you and Beat Bagz about the Site and your purchases.
